1. Who the provider is
The provider of Proviato (proviato.com, app.proviato.com and the app Provi in the App Store and in Google Play) is Paul Hellmann, Arlesheimerstrasse 24, 4147 Aesch, Switzerland. Full details in the legal notice. These terms apply to the use of the website and the app.
Who it is for. Buying via app.proviato.com is for persons resident in Switzerland or in Liechtenstein. In the app, you buy Pro and Max in your phone’s store: on iPhone from Apple, on Android via Google Play, in the countries in which the app is offered there.
App from the App Store. For the app Provi from the App Store, Apple’s standard licence agreement for apps (terms of use, EULA) also applies. It governs the use of the app on your device. These terms govern the Proviato service.
App from Google Play. If you buy via Google Play, the Google Play Terms of Service also apply to that purchase. These terms govern the Proviato service.
2. What Proviato is
Proviato is a shopping list, a pantry and an aid for cooking and planning. What the app suggests is a suggestion: the order in the shop, the aisle of an item, a recipe, a shelf life or a line item read from a receipt may be wrong.
When it comes to food, you decide. Recipes and ingredient lists are created partly with a language model. They are not dietary advice. Whether something is still fit to eat and whether you can tolerate it, you check yourself. Anyone who is allergic to something does not rely on the information in the app, but on the packaging.
3. Account
- You must be at least 16 years old to create an account.
- Provide an email address that belongs to you, and confirm it.
- Your password is your responsibility. Whoever has it can access your data.
- An account is for one person. A household is for several: that is what invitations are for.
4. Plans and prices
- Without signing up: a shopping list with up to 20 items, stored only on your device. Sorted by shop, works offline.
- Free, with an account, permanently free of charge: shopping list without limit, pantry, one household for 2 people, 2 shared lists with up to 4 people each. Suggestions only for items you buy frequently. Without receipts, cupboard photo, recipes and meal plan.
- Pro, monthly or annually: household without a limit on people, 10 shared lists with up to 20 people each, suggestions for all items. Per month, 5 receipts and cupboard photos combined, 10 recipes and 10 meal plan days.
- Max, monthly or annually: everything without limit.
You see the prices before you buy. When buying via Link and Apple, they include VAT. When buying via Google Play in Switzerland, no VAT is charged: as a small business, we are not liable for VAT. Paid access applies to the whole household, no matter who in the household buys it. A shared list has the plan of the person who created it.
How things are counted: a month is a calendar month. A recipe is a suggestion from the pantry or an import via link; the dishes from the basic cookbook do not count. A meal plan day is a cooking day in a new plan. A receipt or cupboard photo from which nothing could be read does not count.
5. Trial
Anyone who creates an account has Max for 30 days, without a credit card and without buying anything. If you do not buy anything, Free applies afterwards. Nothing is deleted in the process: pantry, recipes and plans remain; only receipts, cupboard photo, recipes and meal plan are locked. Paid access never arises automatically, only if you buy it.
If you buy via app.proviato.com during the trial, you keep Max until it ends. The subscription only begins then and is only charged then.
If you buy in the iPhone app or in the Android app, the subscription begins immediately and the trial ends.
6. Purchase and payment
In the browser, you buy from us. The payment is handled by Link, a service of Stripe (Sold through Link, LLC): Link collects the amount, accounts for the VAT and sends you a receipt and an invoice. The payment is additionally subject to Link’s terms, which you see on the payment page.
- You can pay, for example, by card, Apple Pay, Google Pay or Link. The payment page shows what is offered.
- You enter your payment details with Link. We do not see them.
- Your card or bank statement shows LINK.COM*. Link sends you receipts and invoices by email.
- Prices are in Swiss francs. If you pay from another country, Stripe converts them into your currency at Stripe’s exchange rate.
- A monthly subscription renews every month, an annual subscription every year, until you cancel.
In the iPhone app, you buy from Apple. Apple sells you access as the merchant. In Europe, this is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland. The purchase is additionally subject to Apple’s terms.
- Payment is made via your Apple ID, using the payment method you have stored there. We do not see it.
- Apple sends you the receipt.
- Abroad, the price that Apple sets for your country applies.
- A monthly subscription renews every month, an annual subscription every year, until you cancel.
In the Android app, you buy via Google Play. In Switzerland, you buy from us, and Google handles the payment as an intermediary. In many other countries, Google itself sells you access as the merchant, namely Google Commerce Limited; which countries these are is shown in Google’s list. The purchase is additionally subject to the Google Play Terms of Service.
- Payment is made via your Google account, using the payment method you have stored there. We do not see it.
- Google sends you the receipt by email.
- The price that Google Play shows you before you buy applies.
- A monthly subscription renews every month, an annual subscription every year, until you cancel.
7. Cancellation and refunds
Bought via Link: You can cancel at any time in the app: gear icon in the header, ‘Your access’ card, ‘Manage subscription’. There you can also change the plan or the card.
Bought via Apple: You can cancel and change the plan in the iPhone settings or in the app via ‘Manage subscription’, which opens Apple’s subscription management. If you cancel later than 24 hours before the end of the term, Apple renews the subscription once more. Apple’s instructions.
Bought via Google Play: You can cancel in Google Play under ‘Subscriptions’ or in the app via ‘Manage subscription’, which opens Google Play. Google’s instructions.
After cancellation, your access continues until the end of the paid period; after that, Free applies.
Refund within 14 days. If you bought via Link or via Google Play and you write to hallo [at] proviato.com within 14 days of a payment, you will get the amount of that payment back, without giving a reason. The paid access then ends immediately. After that, there is no refund for partial months or years, unless the law requires it. Mandatory statutory rights, such as a right of withdrawal, remain unaffected.
Refunds from Apple. If you bought in the iPhone app, you request a refund from Apple at reportaproblem.apple.com. Apple decides on it. We cannot refund a purchase made through Apple ourselves. You also exercise the statutory right of withdrawal for consumers in the EU with Apple.
Refunds from Google. If you bought via Google Play, you can also request a refund directly from Google (Google’s instructions); Google decides on it. If Google is your merchant, you exercise the statutory right of withdrawal with Google. Our 14 days apply in addition.
8. When someone leaves the household
- Only the person who bought the subscription manages and cancels it. The others in the household see who pays.
- If the paying person deletes their account and the household remains, a subscription via Link is cancelled at the end of the paid period. From then on, the household has Max as a trial, until 30 days after that end. This second trial is available only once per address of the paying person.
- No one can remove the paying person from the household. They can only leave themselves.
- If the last member deletes their account, the household is deleted and a subscription via Link ends immediately. There is no refund for the remaining period, except under section 7.
- Provi does not cancel a subscription via Apple or Google Play for you, not even when you delete your account. Cancel it in the iPhone settings or in Google Play, otherwise it will keep renewing. If the household remains, access continues to apply to it as long as the subscription renews. In that case, there is no second trial.
- If someone else leaves, nothing changes regarding the subscription.
9. Your content
What you enter belongs to you: list, pantry, recipes, notes, photos. We use this content to operate the service for you, and for nothing else. We do not sell it and do not analyse it for advertising. What is passed to third parties for providing the service, and what is not, is set out in the privacy policy.
If you upload a photo, you must hold the rights to it. Do not upload anything that shows other people who have not agreed to it.
10. What is not allowed
- using other people’s accounts or obtaining access that does not belong to you,
- scraping the service by automated means, overloading it or circumventing safeguards,
- uploading unlawful content,
- misusing other people’s email addresses for invitations.
11. Availability
Proviato is under development. There may be outages, maintenance windows, errors, and features may change or be discontinued. No particular availability is guaranteed. We do our best, but we do not promise uninterrupted use.
Your data is stored on a server and backed up. Nevertheless, the app is not an archive. Keep a record elsewhere of anything that matters to you.
12. Liability
We are liable for intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law; this applies in particular to loss of profit, lost data and indirect damage. Mandatory rights to which you are entitled as a consumer remain unaffected. We are liable without limitation for injury to life, body and health.
13. End of use
You can stop at any time. In the app, under ‘Close account’, you delete your account with everything attached to it; there is no notice period. If a subscription is running for your household, the app shows you before deletion what will happen to it (section 8).
We may block or delete an account if someone breaches section 10 or seriously misuses the service. Where possible, we will let you know in advance.
14. Changes to these terms
We may change these terms if the service changes. We will announce material changes in advance by email or in the app. If you do not agree, you can delete your account.
15. Governing law and place of jurisdiction
Swiss law applies, excluding the conflict-of-laws rules of private international law and excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the registered place of business of the provider. If you live in Switzerland, in Liechtenstein or in the EU as a consumer, you can also bring proceedings at your place of residence, and the mandatory provisions of your country of residence remain applicable.
Languages. These terms exist in German, French, Italian and English. In case of discrepancies, the German version prevails.
